Terms of Service
By placing an order with Level Property Media, LLC (“Service Provider”), you (“Client”) agree to the following terms:
Services
* We provide the media services you select at checkout (photos, video, drone, floor plans, etc.).
* Photo quantity is determined by the photographer based on property size and layout.
* Deliverables depend on your selected package and add-ons.
Delivery & Approval Process
* Previews are delivered watermarked for Client review.
* One (1) round of minor adjustments is included (must align with the original scope).
* Submit any revision requests within 3 business days of receiving previews.
* Full payment is required before non-watermarked finals are released.
* Payment after preview review = final acceptance of deliverables.
* Raw/unedited files are not provided.
* Final media typically delivered within 1 business day after payment.
Client Responsibilities
* Property must be clean, staged, and photo-ready before the scheduled shoot.
* Ensure timely access to the property.
* 24+ hours notice required to cancel or reschedule.
* If the photographer cannot access the property within 20 minutes, it may be marked as a no-show (50% fee).
Payment
* No upfront payment required.
* Payment due after preview approval and before final delivery.
* Payments made via Aryeo unless otherwise agreed in writing.
* Non-refundable once finals are delivered.
* Late payments may incur a 2% monthly fee (or maximum allowed by law).
Cancellations & Rescheduling
* Cancellations made under 24 hours before the appointment may incur a 50% fee.
* Weather-related reschedules are at our discretion for safety and quality.
Media Rights
* Level Property Media, LLC retains full copyright to all photos and videos.
* Client receives a limited license to use media only for marketing the specific property ordered.
* Media may not be resold, transferred, or reused for other listings without written consent.
* We may feature select media in our portfolio or marketing materials.
* Clients may request in writing that media not be used publicly.
Liability & Recording
* Total liability is limited to the amount paid for the service.
* We are not responsible for property damage or personal injury except in cases of gross negligence.
* For liability protection and documentation of property condition, the photographer may use a body-worn or equipment-mounted camera that records video only (no audio).
* Recording begins upon arrival and ends upon departure.
* Footage is used solely for internal review, property-condition documentation, insurance, or legal purposes.
* By booking services, Client confirms they have obtained all necessary permissions from homeowners, tenants, and any on-site parties for video-only safety recording.
Drone Operations
* All flights comply with FAA Part 107 regulations.
* Drone operations may be canceled, delayed, or adjusted for weather, safety, or airspace restrictions.
Confidentiality
* Client information is kept private and secure.
* We only share data when legally required.
Revisions
* One (1) round of minor revisions included.
* Additional revisions or out-of-scope edits billed at the standard rate listed on the order form.
Force Majeure
* We are not responsible for delays caused by events beyond our control, including:
* Natural disasters
* Illness or injury
* Equipment failure
* Power outages or accidents
* Acts of God or government restrictions
Client Materials & Property Access
* Client is solely responsible and confirms full authority, consent and permission from property owner or appropriate party for photography, videography, and recording at the property prior to scheduled appointment.
* Client is solely responsible for HOA approvals, building access, and ensuring property readiness.
Third-Party Use
* Client ensures third parties (agents, stagers, contractors, etc.) follow these Terms and usage restrictions.
Limitation on Claims
* Any concerns or disputes must be submitted in writing within 7 days of delivery.
* After 7 days, all media and services performed are considered accepted and final.
Non-Payment & Collection
If payment is not received within 48 hours of invoice, we may:
* Withhold final deliverables
* Suspend future services
* Pursue collections or legal action, including reasonable attorney’s fees and costs
Indemnification
* Client agrees to indemnify and hold harmless Level Property Media, LLC from any claims or damages arising from media use, including:
* MLS or copyright violations
* Misrepresentation of property features
* Third-party complaints or disputes
Governing Law
* These Terms are governed by the laws of California.
Dispute Resolution
* Any disputes must first go through mediation in Los Angeles County before arbitration or litigation.
Severability
* If any part of these Terms is found unenforceable, the remaining sections stay fully valid and enforceable.
Entire Agreement
* These Terms form the entire agreement between Client and Service Provider.
* No verbal promises or side agreements are binding unless in writing and signed by both parties.
* Electronic acceptance via Aryeo or other booking platform equals a signed agreement.
